Exclusive Use and Self Catered Rental Agreement

Terms and conditions Including Conditions of Booking (Including Boschetto Cottage)

  1. Contract 
    Set out below are the conditions of booking which we ask you to read carefully since when you make a booking, and we accept it, a contract is made.
  2. Information
    • We take care in providing accurate information on our website relating to our property but nothing on the villa website shall be treated as a term or condition of this contract. Differences between the photograph, illustrations and/or text used and the actual rental property may arise.
    • Villa Marae Ltd reserve the right to make modifications to the rental property specifications that are considered necessary in the light of operating requirements.
    • Villa Marae Ltd reserve the right to alter furniture, fittings, amenities, facilities, or any part of any activities, either advertised or previously available without prior notice.
  3. Exclusive Use or Self-Catered Accommodation Payment
    • A non-refundable deposit of 30% of the total rental price is payable at the time of booking; unless this is within 10 weeks of the departure date in which case the full amount is payable. The deposit should be accompanied by a fully completed and signed booking form. Cancellation insurance is strongly recommended.
    • Deposits for exclusive use or self-catered accommodation payment must be made by Bank Deposit in Euros. A confirmation/invoice of your booking will then be sent to you.
    • The final balance must be paid at least 10 weeks prior to departure. Key collection details will be sent out 2-3 weeks prior to departure provided full payment has been received. Rental prices include the property rental and vat (if any) Only. Extra charges may include: a refundable breakage guarantee, utility charges, for air conditioning, heating, extra linen hire and extra cleaning. Please check the prices of any such extras at the time of booking.
  4. Special requests
    Special requests should be made at the time of booking in writing and we will send written acknowledgement of same. If any of a party is handicapped, please advise us. Please note: The villa is spread over a large area with many 1-2 steps. We do not consider the villa wheelchair friendly.
  5. Villa arrival times
    These are normally between 1600 -2000. Departure before 10.00. Usual changeover day is Saturday. Late arrivals may incur extra charges and are not always possible. Unusual hours of arrival or departure must be at pre-arranged time otherwise we cannot guarantee entrance to the property until the next working day. Please call the key holder en route if unforeseen circumstances mean a delay.
  6. Cancellation
    • If we change or cancel your booking. If for any reason we have to make an alteration to your arrangements we will notify you immediately and try to offer an accommodation of a similar or superior standard. This may be of the lesser, equivalent or greater rental price. Should this not be acceptable we will refund your payment in full. We are unable to accept any liability for any collateral independent arrangements e.g. flights.
    • If you cancel your booking. Cancellations must be confirmed in writing with receipt of acknowledgement. If you cancel up to 90 days prior to arrival the deposit is forfeit (lost).
    • Less than 90 days you will be responsible for the holiday balance. We recommend cancellation insurance.
  7. Property insurance
    ~~ Clients should have insurance covering damage to rented property.~~
  8. Refundable breakage/security deposits
    • A security deposit is payable upon arrival (amount specified prior to booking AND in confirmation) at the rental property directly to the key holder. The client is responsible for leaving the rental property in a neat and tidy condition, known as ‘broom clean’ i.e. dishes put away and garbage taken out. Any loss or damage caused by failure to respect rental property, fixtures or fittings located in the rental property will be deducted by Villa Marae Ltd from your security deposit.
    • At the end of the rental Villa Marae Ltd shall inspect the rental property and if the rental property is tidy and there is no loss or damage to the rental property, Villa Marae Ltd will return the security deposit to the client.
    • Deposit amounts in cash upon arrival:
      – Main Villa Exclusive Use: €1500 – More may be required for events/special hires. This will be confirmed BEFORE booking
      – Boschetto Cottage: €500
  9. Expenses in contract price
    The contract price includes: the use of the rental property and any facilities and /or services agreed at booking. Client(s) familiarize themselves with this information. Two sets of linens per bed and two sets of towels per person per week are included in the price of the rental, as are basic cooking utensils, pots, pans, glassware, flatware and dishes. Normal use of gas, electricity and water facilities are also included unless otherwise stated.
  10. Not included in contract price
    Consumables are not included in the contract price. This includes, but is not limited to: food and beverages, cleaning supplies, toilet paper, paper towels and napkins, travel arrangements or insurances.
  11. Requesting additional services
    For requests for added services, such as maid and cook services, or air conditioning, the request must be made in writing to Villa Marae Ltd no later than when your final payment is due. These services are not guaranteed and are not included in the contract price unless otherwise specified in the individual property information. Payment is due in full in cash Euros to the key holder upon arrival to the rental property unless stated in the property description and cannot be paid by credit card.
  12. Your responsibility
    1. To only take the number of named persons stated at the time of booking (up to the maximum occupancy stated in the villa description)
    2. To leave the property in the good order and undertake to inform Villa Marae Ltd of any damage or change to the property or its contents and pay for the same.
    3. Villa Marae Ltd reserve the absolute right to require any individual to vacate the rental property for disruptive behaviour or for wilful damage to the property or abusive and/or violent actions toward any of the staff without any refund or liability or recourse.
  13. Complaints
    We do our best to ensure that you will have an enjoyable holiday. If you have any complaint the onus is on you to report it immediately to the local contact person or agent so that action can be taken straight away. We cannot accept liability for complaints after return to your home country unless they have been reported during your holiday and sent to us in writing within 21 days after your departure.
  14. Jurisdiction
    Villa Marae Ltd of and the client agree that this contract will be governed by English law and that exclusive jurisdiction over all disputes arising from this contract shall be in the English courts.
  15. Miscellaneous
    This contract shall become legally binding on the client when the client executes this contract and Villa Marae Ltd confirm this contract by issuing a confirmation invoice. The client is responsible for payment of the contract price asked in the booking details and in this contract and the compliance of members of the client’s party with these conditions. Bookings cannot be accepted from persons less than 18 years of age at the time of booking and Villa Marae Ltd reserve their right to refuse a booking without reason.
